Alizzi v. Alizzi
Florida Court of Appeals
350 So. 3d 758 (2022)
- Written by Eric Miller, JD
Facts
Joseph Alizzi and Brenda Alizzi had a 23-year marriage during which they lived in an expensive home. The couple separated, and Brenda moved in with her daughter from a previous marriage. Brenda paid her daughter $1,800 per month for rent and utilities. Brenda also withdrew $75,000 for use as a down payment on a larger home for her, her daughter, and her daughter’s sons. At this point, Brenda’s only income was $3,424 per month in Social Security and pension money. Brenda sought an award of temporary alimony from the circuit court. Brenda’s forensic accountant testified that Brenda needed $10,174 per month, but the accountant acknowledged that this amount was based on anticipated expenses rather than actual expenses—and with anticipated expenses including $7,000 per month for a furnished apartment. In contrast, Joseph’s forensic accountant testified that that Brenda needed $6,858 per month. The court awarded Brenda $1,494 per month. Brenda appealed.
