Facts
Richard Alsenz (plaintiff) was married to Marjorie Alsenz (defendant). Before Richard was married, he patented several refrigeration inventions. These patents generated royalties during his marriage. None of Richard’s inventions that were patented during his marriage generated royalties during his marriage. Richard petitioned for a divorce, and the trial court held that Richard’s royalty income during his marriage was community property. Richard appealed, arguing that his intellectual-property royalty payments were akin to oil and gas royalties, which constituted separate property.
