Facts
Summer Ammarell (plaintiff) married Ryan Ammarell (defendant). Ryan owned a business in North Carolina, where he regularly traveled to and met Megan France (defendant). Ryan began having an affair with France. Eventually, France told Summer of the affair. France wanted to have a child with Ryan. She bought him a home and a car and offered him $1 million to leave Summer. Summer and Ryan’s marriage fell apart. Ryan began suffering mental-health issues, which led Summer to seek custody of their child. Summer sued France for alienation of affection and criminal conversation. France moved to dismiss the claims, arguing they were unconstitutional. Specifically, France claimed that the torts violated her right to engage in consensual sexual relations and her First Amendment rights. A magistrate judge recommended denying the motion to dismiss, and the matter went before the district-court judge.
