Facts
Stephen Andrle (defendant) obtained a private disability-insurance policy while he was married to Deanna Andrle (plaintiff). The policy was not related to Stephen’s employment, and Stephen paid the policy’s premiums using community-property funds. During the marriage, Stephen became disabled, and the insurance company denied coverage. Stephen sued the insurance company and won a lump-sum settlement payment and future monthly disability payments. Stephen and Deanna thereafter filed for divorce. The trial court found that the settlement and future monthly payments were community property that belonged equally to Stephen and Deanna. Stephen appealed, arguing the future monthly payments were separate property.
