Facts
Joni Asper’s (plaintiff) father rented an apartment from Haffley (defendant) in which a fire occurred and resulted in Asper’s death. Haffley had installed storm windows which could only be opened by breaking them. There was evidence that Joni attempted but was unable to break through the storm windows, which would have been the only means of escape because the door was blocked by the fire. The trial court granted summary judgment against Asper for failure to allege sufficient facts to establish a cause of action based on landlord liability and a theory of negligence. Asper appealed.
