Facts
Guita Bahramipour (plaintiff), a former securities broker for Citigroup Global Markets, Inc. (Citigroup) (defendant), sued Citigroup in state court for alleged violations of federal and state labor laws. One of Bahramipour’s claims alleged that Citigroup misclassified securities brokers as exempt employees under the Fair Labor Standards Act (FLSA) and unlawfully denied them overtime compensation. Bahramipour also alleged that the misclassification violated California’s unfair-competition law. Bahramipour indicated her intent to move to certify an opt-out class of similarly situated workers. Citigroup removed the lawsuit to federal court and moved for partial summary judgment, arguing that the FLSA preempted Bahramipour’s claim under the California unfair-competition law.
