Facts
Claude Davis Ballew (defendant) managed an adult theater. Ballew was charged with distribution of obscene materials. At trial, the court empaneled a jury of five people, as was its custom for misdemeanor cases. Ballew objected and moved the court to use a 12-person jury. The trial court denied the motion, and the jury convicted Ballew.
