Facts
In 1972, Cecile Bertha Baril (plaintiff) divorced Wilfred Antonio Baril (defendant). The district court ordered Wilfred to pay $25 per week in child support to the couple’s daughter, Irene Baril. Wilfred met his weekly obligation and ceased the support payments after Irene reached the age of 18. In response, Cecile sued Wilfred for contempt, arrearage, and attorney’s fees pursuant to the suit. The district court found that Irene had reached the age of majority but that Wilfred’s child-support obligation was still in effect because Irene was disabled. Accordingly, the court ordered Wilfred to pay the arrearage. Wilfred appealed to the superior court. The superior court affirmed. Wilfred appealed to the Main Supreme Judicial Court.
