Facts
Adnan Bchara (defendant) and Marja Bchara (plaintiff) married in March 1991, and the couple had one son in March 1995. Adnan claimed the couple stopped having sexual intercourse after their son’s birth and admitted to having affairs, claiming Marja allowed these affairs. In January 2000, Marja and a friend discovered a video of Adnan having sex with another woman. Marja testified that she moved the husband’s belongings into a guest bedroom the same day. The friend also testified she saw Adnan and Marja living separately and apart when she visited later in January 2000. Marja stopped depositing money into their joint account and stopped going to social functions with Adnan. Marja testified that she bought groceries, did the laundry, and cooked for Adnan. The couple continued to live in the same home until April 2001, when the trial court awarded the house to Marja. The commissioner in this case determined Adnan committed adultery that led to the dissolution of the marriage but did not grant divorce on this ground due to Marja’s recriminations. The trial court ultimately granted a divorce a vinculo matrimonii, finding the parties had lived separate and apart since January 2000.
