Facts
Tencent Weishi, a well-known Chinese tech company, obtained a registered trademark on the name of its smart glasses—i.e., spectacles with built-in cameras. The Mandarin term “weishi,” meaning “micro shows,” was part of the trademark. Beijing Microview New Era Technology Company Ltd. (Beijing Microview) (plaintiff), a company specializing in high-tech image processing, petitioned the Chinese intellectual-property office (defendant) for invalidation of the trademark. Beijing Microview argued that Tencent Weishi’s trademark was likely to cause public confusion with Beijing Microview’s own trademarked brand name, which was established in 1994. The intellectual-property office dismissed Beijing Microview’s claims. Beijing Microview appealed to the Beijing Intellectual Property Court.
