Facts
Robert Bell (plaintiff) and Jan Bell (defendant) were married for two years. During the marriage, the couple purchased a home for $62,000. A $15,000 down payment consisting of Robert’s separate property was made to purchase the home. Upon the Bells’ divorce, the jury recommended that the community property be divided 60 percent to Jan and 40 percent to Robert. As part of Jan’s distribution, the trial court awarded her the home. Robert appealed.
