Facts
Ahmed Salem bin Ali Jaber (plaintiff) sued the United States (defendant) in connection with the unintended killing of bin Ali Jaber’s family members in an American drone attack on suspected terrorists in Yemen. Bin Ali Jaber sought a declaratory judgment that because the drone attack served no valid military purpose, both international law and federal statutes entitled surviving members of bin Ali Jaber’s family to compensatory damages. The federal district court dismissed the suit. Bin Ali Jaber appealed to the District of Columbia Circuit.
