Facts
Graydon R. Boles (plaintiff), a former student at the University of South Florida (USF), took a political science class taught by Michael T. Gibbons (defendant). Boles alleged that he was forced to read profane language as part of the course curriculum and filed a suit for damages against Gibbons, who was promised indemnification by USF. USF’s president stated that Gibbons was acting within the scope of his employment in assigning the readings. Gibbons moved to dismiss on the ground that the State of Florida was the real party in interest to the suit.
