Facts
Thomas Brown (plaintiff) and Gina Brown (defendant), a married couple, had the windows on their home installed by Chris Craft. The Browns became friendly with Craft and his spouse. Later, Thomas discovered that Craft and Gina were having phone conversations and meeting in secret—both at the Browns’ home and in the parking lots of various restaurants at which they would meet for lunch. In a subsequent divorce proceeding filed by Thomas, it was established that a sexual component existed in the relationship between Gina and Craft—e.g., fondling. The family court held that Thomas failed to show evidence sufficient to support a finding of adultery. Thomas appealed to the South Carolina Court of Appeals.
