Facts
An anti-war demonstration at Yale University in 1972 devolved into a physical altercation between police and protestors. Officer Peter Ematrudo (defendant) rushed to assist a police detective who had been knocked to the ground and attacked by several students. Ematrudo issued an unheeded verbal warning, then used his blackjack to subdue a demonstrator assaulting the detective. The blackjack hit Karen Brudney (plaintiff) in the head, causing mild injury, before hitting its intended target. Brudney sued Ematrudo for assault and battery.
