Facts
In 2019, the New Hampshire House of Representatives amended a house rule to prohibit its members from carrying deadly weapons in the house chamber. State Representative John Burt (plaintiff) filed a complaint against Speaker of the House Stephen Shurtleff (defendant), alleging that the rule violated his fundamental right to bear arms under the New Hampshire Constitution. The superior court dismissed the complaint, holding that the issue was a nonjusticiable political question. Burt appealed.
