Byrne v. Byrne
New York Supreme Court
650 N.Y.S.2d 499 (1996)
- Written by Serena Lipski, JD
Facts
Linda Byrne filed for divorce from Luck Byrne. Luck had a laptop computer from his employer, Citibank, that he kept at home during the couple’s marriage. The couple’s children used the computer for homework. Because Linda believed the computer contained information about finances relevant to the divorce proceedings, Linda removed the computer from the marital home and gave it to her attorney. Luck argues that nothing relevant to the divorce is on the computer and that Linda improperly removed the computer. Citibank intervened, arguing that the computer belongs to Citibank and therefore should be returned.
