Charisma R. v. Kristina S.
First District Court of Appeal of California
44 Cal. Rptr. 3d 332 (2006)
- Written by Sean Carroll, JD
Facts
Charisma R. (defendant) and Kristina S. (plaintiff) were domestic partners. With Charisma’s consent, Kristina was artificially inseminated and gave birth to Amalia. Charisma and Kristina broke up, and Kristina moved out and took Amalia with her. Charisma filed a petition seeking to establish that she was the legal parent of Amalia. The trial court found that because Charisma had no biological tie to Amalia, Charisma did not have standing to file the petition. Charisma appealed.
