Facts
In 1986, African American registered voters in Louisiana brought suit alleging a § 2 violation. This suit challenged the constitutionality of Louisiana's First Supreme Court District's elections. The trial court dismissed the suit as concerning a nonjusticiable political question. The United States Court of Appeals for the Fifth Circuit reversed and remanded. At the district court, voters sought a preliminary injunction. Voters sought to forestall the October 1, 1988 election for Justice Calogero's seat on the Louisiana Supreme Court. Justice Calogero began serving on the Louisiana Supreme Court in 1972. Note that Louisiana Supreme Court decisions very often resolved a case within a 4-3 margin. The district court granted the injunction, resulting in an appeal to the United States Court of Appeals for the Fifth Circuit.
