Facts
In 1994, Christina Giovine (plaintiff) filed a complaint against her husband, Peter J. Giovine (defendant) that claimed extreme cruelty as a basis for their divorce and included counts alleging assault and battery occurring in 1972, intentional infliction of emotional distress beginning in 1972, and continuous wrong between 1972 and 1993, all resulting in severe emotional and physical damage. The family court refused to recognize battered woman’s syndrome as a continuous tort and, consequently, refused to exempt Christina’s claims from the typical rule that all tort claims must be commenced within two years of the cause of action. Christina appealed.
