Facts
Federal law requires states participating in the Medicaid program to provide dental care for needy children. States may also opt to provide covered dental care for adults. California provides such adult dental care via the Denti-Cal program. Approximately 40% of licensed dentists in California participated in the Denti-Cal program, and of those providers, only a small percentage fully accepted recipients without limitation. Denti-Cal recipients, including Virginia Clark (the Medicaid beneficiaries) (plaintiffs), sued Kenneth Kizer (defendant), contending that California’s Medicaid program violated various federal provisions as to the provision of and reimbursement for dental care.
