Facts
Margaret Cluck (plaintiff) and Elwood Cluck (defendant) were married. The San Antonio Country Club (the club) was a voluntary association and nonprofit corporation with strict membership requirements. The club’s board of governors (the board) had the sole authority to grant and terminate membership. The board granted Elwood membership in the club in his name only. Upon divorce, the trial court awarded Elwood’s membership in the club to Margaret. Elwood appealed.
