Facts
Jay Cohen (plaintiff) and Helene Cohen (defendant) were married. Upon the Cohens’ divorce, a divorce court entered a judgment awarding Helene cash on hand. The Cohens had significant personal and real property. The court gave Jay a choice of whether to pay the full amount of cash to Helene or pay Helene incrementally and pay 10 percent interest on unpaid amounts. Jay did not appeal the divorce judgment. Six years later, Jay challenged the judgment, arguing that Texas only permits a 6 percent interest rate on unpaid judgments. The trial court granted Helene’s motion to dismiss. Jay appealed.
