Facts
Connecticut Mutual Life Insurance Company (Mutual Life) (plaintiff) carried a life-insurance policy on Dr. Samuel Beach. Beach died in a manner that would make the New York and New Haven Railroad Company (the railroad company) (defendant) arguably liable for his death. Mutual Life filed a claim against the railroad company for causing Beach’s death, claiming damages equal to the amount of the life-insurance policy.
