Facts
Constantin Film Verleih GmbH (Constantin) (plaintiff) held the German exploitation rights to the Hollywood films Parker and Scary Movie 5, both of which were uploaded onto YouTube without Constantin’s authorization. Constantin brought suit against YouTube LLC (defendant) and its parent company, Google Inc. (defendant), in the regional court of Frankfurt am Main. Constantin sought a court order that would force YouTube and Google to turn over the email addresses, telephone numbers, and IP addresses of the uploaders. The court dismissed the request. Constantin appealed to the higher regional court, which granted the request with respect to email addresses only. Constantin appealed to the Germany Federal Court of Justice, seeking the phone numbers and IP addresses of the users in question. YouTube and Google filed an appeal of their own, seeking dismissal of Constantin’s request in its entirety. The federal court referred the matter to the European Union Court of Justice for a preliminary ruling.
