Facts
Credit Bureau of Eastern Idaho, Inc. (CBEI) (plaintiff) obtained a judgment of approximately $800 against Jeff Lecheminant. Thereafter, Jeff married Sandy Lecheminant (defendant), who was employed at the Eastern Idaho Regional Medical Center (the medical center) (defendant). CBEI sought to garnish Sandy’s wages to satisfy the judgment. Sandy and the medical center claimed that Sandy’s wages were exempt from garnishment pursuant to a specified Idaho statute. The statute provided that all property and compensation belonging to any “married woman” was “exempt from execution against her husband.” There was no equivalent statute applicable to married men. CBEI filed a motion to contest the claim of exemption, which the trial court denied. CBEI appealed, arguing that the Idaho statute was unconstitutional in violation of equal protection.
