Facts
The Hillsboro Independent School District (HISD) (plaintiff) hired D.S.A., Inc. (DSA) (defendant) to build a new school. The constructed building suffered from several defects that HISD needed to fix. HISD sued DSA for breach of contract and negligent misrepresentation, seeking reimbursement for the costs HISD expended to fix the defects in the constructed building. The jury found in favor of HISD on both claims and awarded equal damages for each claim. The court of appeals affirmed. DSA appealed, arguing that the negligent-misrepresentation claim was essentially a contractual claim and that HISD double-recovered.
