Facts
Diane Von Furstenberg Studio (DVF) (plaintiff) was a designer and producer of high-end women’s apparel identified by federally registered trademarks. Catherine Snyder (defendant) sold counterfeit DVF dresses on eBay that bore a DVF mark without DVF’s consent. DVF sued Snyder, and the district court granted DVF a temporary restraining and seizure order and related relief. After seizing dresses bearing the DVF mark and financial records from Snyder, DVF moved for summary judgment on its claim for trademark dilution. Snyder argued that it would take a trained eye to distinguish the dresses she sold from those sold by DVF, although she also admitted that dresses had been returned to her by customers because of shoddy workmanship.
