Facts
Beijing Microlive Vision Technology Company, Ltd. (Beijing Microlive Vision) (plaintiff) held the rights to a short video, “I Want to Tell You,” created by the artist Xie for the Douyin (aka Tik Tok) platform. However, the same video appeared on another mobile platform, Huopai, with the Douyin watermarks removed. Beijing Microlive Vision asked Huopai’s operators, Baidu Online Network Technology (Beijing) Company, Ltd. and Beijing Baidu Netcom Science and Technology Company, Ltd. (collectively, Baidu) (defendant), to remove the video. Although Baidu complied with the request in a timely manner, Beijing Microlive Vision brought a copyright-infringement suit.
