Facts
Matt Dubay (plaintiff) and Lauren Wells (defendant) had a romantic relationship. Dubay told Wells that he did not want to be a father, and Wells assured him that she was infertile and using contraception. Dubay and Wells then had sexual relations. Wells became pregnant with Dubay’s child, and though Dubay continued to tell Wells that he did not want to be a father, Wells gave birth. The county sued Dubay under the Michigan Paternity Act (MPA), seeking establishment of paternity, establishment of child support, and other expenses. Dubay then filed a separate suit against Wells and the county, arguing that the MPA violated his equal-protection rights because Wells had the right to engage in consensual sexual relations with Dubay and the right to choose to avoid becoming a mother but Dubay did not have the same right.
