Facts
Arthur Edwardson (defendant) and his wife, Marcella Edwardson (plaintiff), entered into a prenuptial agreement that provided for maintenance payments of $75 per month if the Edwardsons got divorced. The Edwardsons divorced, and Marcella sought enforcement of the prenuptial agreement in the Jefferson Circuit Court. The circuit court denied enforcement based on Kentucky precedent rendering prenuptial agreements void. The court of appeals affirmed. The Supreme Court of Kentucky granted review.
