Facts
Virginia Eggemeyer (plaintiff) and Homer Eggemeyer (defendant) were married. Upon divorce, the trial court awarded Virginia the community-property interest in the family’s farm. Homer owned one-third of the farm as his separate property by a gift from his mother. The trial court divested Homer of his one-third interest and gave it to Virginia. The court also required Homer to pay $100 per child per month to Virginia in child support. In exchange, Virginia assumed all existing debts on the property as well as a new $10,000 debt to Homer to be payable when the first child turned 18. The court of civil appeals reversed, holding that a court may not divest a spouse of his title to separate property. Virginia appealed.
