Facts
Sandra Elmore (plaintiff) bought a car from Mission Rambler Company (Mission) (defendant). A key part, the drive shaft, was not properly attached, causing the car to swerve. This led to an accident in which Elmore not only sustained injuries but also swerved and collided with Anna Waters (plaintiff), causing injuries to Waters. Elmore and Waters brought suit against the car’s manufacturer, American Motors Corporation (American) (defendant), and Mission. The trial court granted motions for nonsuit. Elmore and Waters appealed. The California Supreme Court granted certiorari.
