Facts
John Bible (plaintiff) was married and subsequently divorced. The divorce court entered a judgment ordering John to execute a deed to specified property within 10 days. John refused to execute the deed within this time and instead appealed the judgment. The district court ordered John to appear for a hearing to show cause why he should not be held in contempt. John responded in writing to the court but did not appear at the hearing. The judge therefore held John in contempt and ordered him jailed. John filed a writ for habeas corpus arguing that his detention was illegal, and the Texas Court of Civil Appeals agreed to review the case.
