Facts
Experience Hendrix, LLC (plaintiff) sold merchandise under registered trademarks showing the name and image of the late, famed rock musician Jimi Hendrix. Experience Hendrix’s wide-ranging product line extended to T-shirts, posters, and shot glasses, all of which were items that another company, Electric Hendrix, LLC (defendant), used to promote vodka branded with Hendrix’s name and image. Both companies relied on internet marketing targeting Hendrix’s fans. Experience Hendrix sued Electric Hendrix for trademark infringement and related torts. Experience Hendrix moved for summary judgment based on evidence that at least some consumers were confused by both companies’ use of Hendrix’s name and image. The court analyzed the likelihood-of-confusion issue by applying the eight-factor test first employed in AMF Inc. v. Sleekcraft Boats, 599 F.2d 341 (9th Cir. 1979).
