Facts
Nashala Hearn (plaintiff) was a student at Muskogee Public School District 020 (defendant). The school had a dress code policy that allowed head coverings for certain nonreligious reasons, but the school would not allow Hearn to wear a hijab as required by her Muslim faith. The school did allow Hearn to wear her hijab for a month. However, on the second anniversary of the 9/11 attacks, the school said Hearn could no longer wear her hijab. In enforcing the policy, the school suspended Hearn twice. Hearn sued the school, and the United States filed a motion in support of her claim.
