Farmer v. Farmer
Court of Appeals of Indiana
735 N.E.2d 285 (2000)
- Written by Sean Carroll, JD
Facts
Robert Farmer (defendant) and Susan Feliciano (plaintiff) were divorced and had one child. The divorce decree awarded Feliciano custody of the child and ordered Farmer to pay child support. Feliciano filed a petition for rule to show cause for failing to pay child support. Farmer filed a petition to modify his visitation rights. The trial court issued a modification order, stating that if Farmer continued to fail to pay child support, his continued visitation would endanger the child. Accordingly, the trial court found that if Farmer failed to pay child support going forward, the court would terminate his visitation rights. The trial court also held Farmer in contempt for his failure to pay child support, but suspended his sentence so long as he continued to visit the child. Farmer appealed.
