Facts
Petzl America, Inc. (Petzl) (defendant) manufactured a safety device for rock climbers called the Shunt. At the time that Craig Faulhaber (plaintiff) discussed the Shunt with a Petzl representative, Petzl had advertised the Shunt for use in two-person belaying. However, after the representative recommended the Shunt for top-rope solo climbing, Faulhaber purchased the Shunt specifically for this reason. Faulhaber sustained serious injuries while solo climbing with the Shunt. He filed suit against Petzl, contending that it had breached the implied warranty of fitness for a particular purpose. Petzl filed a motion to dismiss, which the district court took under advisement.
