Facts
In a television advertisement, attorneys John Pape and Marc Chandler (defendants) displayed a pit bull wearing a spiked collar as the firm’s logo and 1-800-PIT-BULL as the firm’s telephone number. The Florida Bar (plaintiff) filed complaints against Pape and Chandler, alleging that the advertisement violated Rules Regulating the Florida Bar 4-7.2(b)(3) and 4-7.2(b)(4). The referee found that the advertisement did not violate the ethical rules and was protected First Amendment speech. The Florida Supreme Court granted review.
