Facts
Shirley Chisholm (defendant) and Melvin Chisholm were married in 1953 and separated in January 1990. In July 1992, Ms. Chisholm admitted Mr. Chisholm to Forsyth Memorial Hospital (Hospital) (plaintiff), where he received necessary medical services and remained until his death two weeks later. The Hospital brought suit against Ms. Chisholm to recover $45,110.07 in unpaid medical bills. Ms. Chisholm denied liability on the basis that the couple was married but living apart at the time the bills were incurred. Summary judgment was granted to Ms. Chisholm and later affirmed by the court of appeals. The Hospital appealed.
