Facts
Robichaux (plaintiff) entered into a contract with G-W-L., Inc. (defendant) for the construction and purchase of a new home. G-W-L completed the construction, but the roof sagged noticeably. Robichaux filed suit for breach of express and implied warranties under the Texas Deceptive Trade Practices Act. A jury found that G-W-L had not breached any express contractual warranties, but had breached the implied warranty of habitability. The trial court awarded damages in favor of Robichaux. G-W-L appealed and the appellate court affirmed the trial court’s judgment. G-W-L petitioned the supreme court for review.
