Facts
John Geesbreght (plaintiff) was a doctor who opened a successful and reputable medical company called Emergency Medicine, which staffed doctors at various hospitals. During John’s marriage to Mary Lee Geesbreght (defendant), John had the right to sell his stock in the company to another doctor. If John sold his shares, the new doctor had the right to retain Emergency Medicine’s contracts if the staffed doctors’ work remained satisfactory. Each hospital’s contract provided the hospital with the option to cancel if the staffed doctors’ work did not remain satisfactory. John filed for divorce from Mary Lee. The trial court valued John’s shares by their book value and did not enhance this value with the company’s goodwill. The trial court then awarded Mary Lee a share of this community property. Mary Lee appealed.
