Facts
Two companies, Global Marine Inc. and Santa Fe International Corp., merged, forming GlobalSantaFe Corp. (Global) (plaintiff). One day after the announcement of the merger, Jongsun Park registered the domain name globalsantafe.com (defendant) with a Korean registrar named Hangang Systems, Inc. (Hangang) and with an American domain-name registry, Verisign Global Registry Services (Verisign). Subsequently, Global filed an in rem action in federal district court against the globalsantafe.com domain name under the Anticybersquatting Consumer Protection Act (ACPA). Park never appeared in court to defend his right to use the domain name. However, Park filed a petition in a court in Seoul, South Korea, and that court issued an injunction preventing the transfer of the domain name because that court believed the United States district court lacked jurisdiction to make such an order. Global sought an order requiring Verisign to cancel the domain name until the domain name was transferred to Global.
