Facts
The mother (plaintiff) filed suit seeking child support from the father (defendant) for the parties’ child. The parties were not married. The trial court held that while the father was the child’s biological father, he had no support obligation because the child was illegitimate. The court of civil appeals affirmed. The Texas Supreme Court denied application for a writ of error. The United States Supreme Court granted certiorari.
