Facts
As a party hosted by the Graffs and the Hausmons (defendants) was winding down, an intoxicated social guest left to drive home. While en route, the guest collided with a motorcycle driven by Beard (plaintiff). Beard sued the defendants for the injuries he sustained. The trial court dismissed Beard’s complaint for failure to state a cause of action. An en banc, divided court of appeals reversed the decision of the trial court and held that social hosts may be found liable to third parties for the acts of their intoxicated adult guests. The defendants appealed. The Texas Supreme Court granted certiorari to review.
