Facts
While shopping at a grocery store owned by H.E. Butt Grocery Co. (HEB) (defendant), Maria Resendez (plaintiff) slipped and fell near two grape displays. One display table contained bagged grapes in boxes. The other display was for customer sampling and contained a bowl of loose grapes. The bowl was level, sturdy, and recessed below the table’s surface. There were also non-slip floor mats and warning cones around the displays. Resendez sued HEB for negligence, claiming that the customer sampling display posed an unreasonable risk of harm to shoppers and caused her injury. She did not offer any other evidence. The trial court held in Resendez’s favor, and the court of appeals affirmed. HEB appealed to the Texas Supreme Court.
