Facts
Halpern (plaintiff) sought to take over some land that was adjacent to his own. Halpern tried to buy the extra land from Lacy Investment Corporation’s (defendant) predecessor in title but was refused. Halpern nevertheless bulldozed, cleared, and included the land as part of his backyard. Halpern sued to quiet title in himself through adverse possession, but the trial court denied his claim because he did not act under a good faith claim of right. Halpern appealed.
