Facts
Hanberry (plaintiff) bought a pair of shoes that Hearst Corporation (Hearst) (defendant) had given its Good Housekeeping seal of approval. When wearing the shoes, Hanberry slipped and fell, causing injuries. Hanberry brought suit against Hearst for negligent misrepresentation, among other things. The trial court dismissed the claim. Hanberry appealed.
