Facts
Albert Hawkins (plaintiff) and Yolanda Hawkins (defendant) were married for two years. During the marriage, the Hawkinses and Yolanda’s teenage daughter lived in a duplex purchased by Albert before the marriage. During the marriage, the Hawkinses’ shared bank account was used to save Albert’s paychecks, rental proceeds from the other half of the duplex, rental proceeds from Yolanda’s separate property, and the daughter’s Social Security checks. Funds in the bank account were used to pay Albert’s mortgage on the separate property, including interest on the loan, and real estate taxes. When the Hawkinses divorced, the trial court awarded the community estate reimbursement of the increase in equity of the property during the marriage. Yolanda was awarded half of this increase. Albert appealed.
