Haxton v. Haxton
Oregon Supreme Court
705 P.2d 721 (1985)
- Written by Brittany Frankel, JD
Facts
James E. Haxton (plaintiff) brought an action against his father, Gene D. Haxton (defendant), seeking support. James was above the age of majority and was not attending school. However, James was mentally disabled, and the trial court determined that James’s disability prevented him from obtaining employment. The trial court found that James could bring the action against Gene. The trial court then ordered that Gene provide $225 in monthly support for James. Gene appealed.
